ANNE RADUNS: In the case of a child born in an intact marriage, there is a presumption that both parents are equal custodians. In a paternity case, the parents aren't married. So the mother is the natural guardian of the child and the father has to petition the court to get those rights.

paternity action is important for both parents. A paternity action will demonstrate if somebody is the biological father and then establish parental rights. The father can seek a parenting plan and the mother can seek child support.
